State of São Paulo authorized to institute an installment program of ICMS debts with reduction of fine and interest

On October 11, Agreement No. 152/2019 was published, authorizing the State of São Paulo to institute an installment program related to ICMS debts, comprising tax events that occurred until May 31, 2019.
The debts included in the program may be paid:
• in a single installment, with a reduction of up to 75% of punitive fines and fines on late payment and up to 60% of other penalties/legal charges; or
• up to 60 installments, with a reduction of up to 50% of punitive fines and fines on late payment and 40% of other penalties/legal charges.
According to the Agreement, the request for inclusion of the debts in the installment program is subject to the withdrawal of related lawsuits and administrative appeals filed by the taxpayer. In addition, in the event of payment in installments, monthly interest will be applied according to the number of installments.
The enrollment to the installation program will be possible once the State of São Paulo publishes specific regulations. This regulation must set the deadline for enrolling in the installment program, which shall not be later than December 15, 2019.
We highlight that on the same date other Agreements were published authorizing the edition of ICMS installment programs by other States.
