Now Open: Sunset Review on antidumping duties in force against Brazilian padlocks imports from China
In brief
SECEX (the Brazilian Secretariat of International Trade) initiated a sunset review on the antidumping duties in force against the Brazilian imports of padlocks from China on 12 November , commonly classified under the NCM code 8301.10.00.
Padlocks made of common metal, mainly in brass, or with a plastic body are used in a variety of applications, such as:
- Padlocks for women’s handbags;
- Padlocks with secret or alphanumeric combination;
- Padlocks for weapons, exclusively the model with a flexible shank or not.
Padlocks for the following intended uses are not included in the scope of the investigation:
- Padlocks for use on bicycles or motorcycles;
- Padlocks for notebooks, cabinets, CPUs e peripherals, with a steel cable lock incorporated into the locking device;
- Padlocks for trigger-locking weapons;
- Padlocks unlocked via biometrics, Bluetooth or other wireless technologies;
- Padlocks whose locking is done by a steel cable or chain, incorporated into the body instead of the shank.

Relevance of stakeholder participation
Active participation of importers, exporters, and any other interested parties in the sunset review may be decisive in securing a more favorable outcome. Interested parties can request to be admitted as parties in the investigation until 2 December 2024, provided that they demonstrate the extent to which they could be affected by the imposition of the antidumping duty.
- Deadline for replying to the Importer’s Questionnaire: 30 days as of acknowledgement of receipt (presumed 3 days after the date of electronic transmission by the authority).
- Deadline for replying to the Exporter’s Questionnaire: 30 days as of acknowledgement of receipt (presumed 7 days after the date of electronic transmission by the authority).
Usually, a public interest assessment may be requested only after the conclusion of the trade remedies investigation, as established by SECEX Ordinance No. 282/2023 (additional information is available in our Legal Alert on the subject).

- Petitioners: Assa Abloy Brasil Indústria e Comércio Ltda. (brand: Papaiz), Pado S.A. Industrial, Comercial e Importadora e Stam Metalúrgica S.A., which together represent more than 80% of the national production.
- Investigated product: Padlocks for common use made of metal, mainly brass, or with a plastic body.
