Now open: antidumping investigations on Chinese exports to Brazil of polyester yarn, polyester fabric, and lysine for animal feed
In brief
SECEX (the Brazilian Secretariat of International Trade) initiated three antidumping investigations on Chinese exports on December 27:
- Textured polyester yarn, commonly classified under the NCM codes 5402.33.10, 5402.33.20, and 5402.33.90 (link to the Official Notice of Initiation, in Portuguese);
- Polyester fabric, commonly classified under the NCM codes 6004.10.31, 6004.10.32, 6004.10.33, 6004.10.34, 6004.90.30, 6006.31.20, 6006.32.20, 6006.33.20 and 6006.34.20 (link to the Official Notice of Initiation, in Portuguese); and
- Lysine for animal feed, commonly classified under the NCM codes 2309.90.90, 2922.41.10, and 2922.41.90 (link to the Official Notice of Initiation, in Portuguese).
The investigation may result in the imposition of antidumping measures and the consequent increase in the cost of Brazilian imports of the related products for a period of five years.
Relevance of stakeholder participation
Active participation of importers, exporters, and any other interested parties in the investigations may be decisive in securing a more favorable outcome. Interested parties can request to be admitted as parties in the investigations until 17 January 2025*, provided that they demonstrate the extent to which they could be affected by the imposition of the antidumping duties.
- Deadline for replying to the Importer’s Questionnaire: 30 days as of acknowledgement of receipt (presumed 3 days after the date of electronic transmission by the authority);
- Deadline for replying to the Exporter’s Questionnaire: 30 days as of acknowledgement of receipt (presumed 7 days after the date of electronic transmission by the authority).
Usually, a public interest assessment may be requested only after the conclusion of the trade remedies investigation, as established by SECEX Ordinance No. 282/2023 (additional information is available in our Legal Alert on the subject).
