Now open: Antidumping investigation on Brazilian imports of hypodermic needles from China

SECEX (the Brazilian Secretariat of International Trade) initiated a new antidumping investigation against Brazilian imports of hypodermic needles from China on 28 August 2024. The products are commonly classified under the NCM code 9018.32.19.

Hypodermic needles are medical devices used for intramuscular, intravenous, subcutaneous, and intradermal access, for the infusion of medicines and extraction of bodily fluids.

Relevance of stakeholder participation

Active participation of importers, exporters, and any other interested parties in the investigation may be decisive in securing a more favorable outcome. Interested parties can request to be admitted as parties in the investigation until 17 September 2024*, provided that they demonstrate the extent to which they could be affected by the imposition of the antidumping duty.

  • Deadline for replying to the Importer’s Questionnaire30 days as of acknowledgement of receipt (presumed 3 days after the date of electronic transmission by the authority);
  • Deadline for replying to the Exporter’s Questionnaire30 days as of acknowledgement of receipt (presumed 7 days after the date of electronic transmission by the authority).

Usually, a public interest assessment may be requested only after the conclusion of the trade remedies investigation, as established by SECEX Ordinance No. 282/2023 (additional information is available in our Legal Alert on the subject).

More details

The new investigation was initiated upon the request of Becton Dickinson Indústrias Cirúrgicas Ltda.

  • Investigated product: Hypodermic Needles are sterile, disposable products for single use in therapeutic procedures. The products under investigation are of three types: (i) conventional, non-safety needles: needles without a safety device; (ii) safety needles: hypodermic needles may contain a safety device, in order to protect the user from accidental injury with the needle at the time of puncture; and (iii) aspiration needles: aspiration needles have the same properties as the application needle (conventional and safety). Their only difference is that they should only be used for aspirating medication. They have a “blunt tip”, a red cannon, and a plastic guard.
  • UsesHypodermic needles are medical devices used for intramuscular, intravenous, subcutaneous, and intradermal access, for the infusion of medicines and the extraction of bodily fluids.
  • Dumping margin – China: 16.93 USD/kg – 261.7%.
