New state laws change he State Consumer Protection Code of Pernambuco

On March 12, 2021, several State Laws in Pernambuco were published to amend State Law No. 16,559/2019, which instituted the State Consumer Protection Code of Pernambuco.
In summary, the new State Law provides specific rules about the display of prices and the need for registration in digital stores, transactions involving motor vehicles, in addition to safety rules for children’s equipment, as detailed below.
- State Law No. 17,172 / 2021
Creates necessities regarding the disclosure of product’s prices in digital stores, that must be made in a legible and clearly way, prohibiting the use of private or non-accessible channels to disclose prices. In addition, suppliers are also required to include information on the stock availability. The State Law will come into effect in January 1st, 2022.
- State Law No. 17,174 / 2021
Prohibits suppliers from requiring prior registration as a condition for the consumers to be informed of the price and other relevant information of the product or service offered in digital stores. The State Law came into effect on the date of their publication.
- State Law No. 17,170 / 2021
Establishes rules regarding the return of the deposit paid by consumers in the event of failure to carry out the vehicle purchase operation. The State Law will come into effect in January 1st, 2022.
- State Law No. 17,169 / 2021
Creates the obligation for suppliers to disclose a written warning informing consumers about the access limitation to children leisure spaces. The State Law came into effect on the date of its publication.
- State Law No. 17,175 / 2021
Includes specific safety rules for the use of elastic beds for suppliers responsible for leisure areas for children. The State Law came into effect on the date of its publication.
