New Equal Pay Regulations – “Portal Emprega Brasil” is updated so that companies can declare the information until February 2024

The Ministry of Labor and Employment has updated the “Portal Emprega Brasil” to enable companies to proceed with the Declaration of Equal Pay and Remuneration Criteria for the first half of 2024, which must be completed by February.
According to the latest regulations on the matter (Decree 11,795/2023 and Ordinance 3,714/2023), companies will have until February and August of each year to declare the information that will comprise Section II of the Salary and Remuneration Criteria Transparency Report.
The Ministry of Labor will use the information declared by companies on the “Portal Emprega Brasil”, along with other data already transmitted on the “eSocial” system, to publish the Transparency Report in March and September of each year.
Recommendation
Given the update of the “Portal Emprega Brasil”, it is crucial that companies are prepared to submit the information requested by the Ministry of Labor and Employment to comply with the recently implemented obligations on the matter.
In addition, companies should complete their internal analysis of the current elements of equal pay and its remuneration criteria to anticipate any necessary adjustments to internal practices and prevent risks from materializing.
