MADRID PROTOCOL ENTERS INTO FORCE TODAY IN BRAZIL
The Decree No. 10.033/2019, which promulgates the Madrid Protocol and incorporates it into the Brazilian legal system, was published this Wednesday, October 2, 2019.
The Madrid Protocol aims at facilitating the filing and management of trademark applications in 122 member countries through the World Intellectual Property Organization – WIPO’s single centralized system. Among its main advantages, we highlight the following: (i) agility/predictability, with maximum term of 18 months to complete the substantive examination; (ii) debureaucratization, through filing of the trademark application in the country of origin; and (iii) cost reduction, with single official fees paid directly to WIPO.
In order to allow the immediate operation of the Madrid Protocol, the Brazilian Patent and Trademark Office (BPTO) has recently made available, among other documents, (i) an updated version of the Trademark Examination Guidelines including the procedures related to trademark registration under the Madrid Protocol system; and (ii) a new schedule of official fees adding services under the Protocol.
