Environment | Brazilian Supreme Court decides that the statute of limitation is not applicable to civil environmental liability
On April 17, 2020, the Brazilian Supreme Court (STF) concluded the judgement of the Extraordinary Appeal No. 644833, with general repercussion, to define that, “the statute of limitation is not applicable to the civil liability for environmental damage”.
Therefore, the Court established a definite understanding in Brazil in the sense that the liability for environmental damage cannot be dismissed with time, thus maintaining the understanding previously adopted by the Superior Court of Justice (STJ).
