BPTO PUBLISHED LATEST RESOLUTIONS ON THE MADRID PROTOCOL
As part of the preparation to start operating the Madrid Protocol on October 2, 2019, the Brazilian Patent and Trademark Office (BPTO) published in the Electronic Official Bulletin No. 2540, of September 10, 2019, two new resolutions that deal with the following points: (i) multiclass trademark registration; and (ii) trademark registration under the Madrid Protocol system.
The resolution on the multiclass trademark registration system establishes that a single trademark application will be able to identify products and services belonging to several classes. According to the BPTO’s new resolution on this matter, the multiclass trademark registration system will be made available via the Office’s online system on March 9, 2020.
In turn, the resolution on trademark registration under the Madrid Protocol aims at ensuring better efficiency and uniformity for registering and managing international registrations and applications. Effective October 2, 2019, the document provides detailed rules regarding the processing of the cases, including the official languages, applicable deadlines, as well as general formalities for filing requirements, records, and amendments related to an international application.
Finally, the BPTO has also disclosed an updated version of the Trademark Examination Guidelines, which explores new examination procedures in relation to (i) multiclass trademark registration; (ii) co-ownership trademark registration; (iii) division of trademark applications and registrations; and (iv) trademark registration under the Madrid Protocol system.
