PROVISIONAL MEASURE # 959/2020 POSTPONES THE EFFECTIVE DATE OF THE BRAZILIAN DATA PROTECTION LAW

Brazilian President published Provisional Measure # 959 yesterday, April 29, postponing the effective date of the Brazilian General Data Protection Law (Law No. 13,709/18 – “LGPD”). As a result, the new effective date of the Law is May 3, 2021. The Provisional Measure has immediate effects, but it must be reviewed and confirmed by Congress in the next 60 days, extendable for additional 60 days, to mature to Law. If it is not voted and confirmed within this period, the Provisional Measure loses its effects. Amid the new coronavirus pandemic, postponement of the LGPD was already a matter of discussion in the Brazilian Congress. Bill of Law # 1,179 / 2020, approved in the Federal Senate and currently under discussion in the House of Representatives, proposed to postpone the effective date of the LGPD to January 2021. In spite of the Provisional Measure, discussion of such Bill of Law is still ongoing. We will continue to monitor the matter and will inform you of new developments in due course. |
