Provisional Measure regulating labor alternatives to deal with the coronavirus spread
Yesterday (22.03), the Government enacted a Provisional Measure (“MP”) with labor alternatives for dealing with the coronavirus in Brazil. Among the provisions, the MP recognizes the coronavirus pandemic as a force majeure, allowing the application of specific force majeure provisions already provided in Brazilian legislation in relation to employee working hours. The MP sets forth the implementation of teleworking, anticipation of individual vacations, implementation of collective vacation, use and anticipation of holidays, implementation of comp time agreements, suspension of administrative requirements in health and safety at work, suspension of the employment agreement for professional qualification purposes, and different terms for collecting the monthly FGTS deposit. By providing for the measures mentioned above, the MP has implemented the flexible requirements foreseen in the labor legislation, allowing companies to adopt immediate measures during this crisis.
