Companies have until May 30th to register for the Electronic Judicial Domicile
In brief
The Electronic Judicial Domicile (DJE), regulated by Resolution No. 455 of the National Council of Justice, is a free digital tool that concentrates, in a single electronic location, all communications regarding judicial lawsuits.
The current phase of the project, which began on March 1, 2024, will end on May 30, 2024. During this period, medium and large private companies must voluntarily register in the system. After that, registration will be compulsory and based on the data made available to the Brazilian IRS.
Details
Registration and updating of data, including the electronic address for receiving summonses, subpoenas and communications, is mandatory for all companies, with the exception only of micro-enterprises and small companies that have an electronic address registered in another system called “Redesim”.
With the implementation of this Electronic Domicile, companies will have three business days, after sending od the summons by the Courts, to confirm that it was received.
The unjustified non-confirmation, due to lack of updated registration, may expose companies to penalties of up to 5% (five percent) of the amount disputed in case.
In relation to other communications (except summons), if there is no confirmation within ten calendar days of their sending, they will be considered automatically confirmed on the end of that period. It is important to clarify that lawyers duly registered in ongoing cases will continue to receive notifications as usual (either by the DJE itself or by publication/notification in the each Court’s electronic systems, until all notifications are centralized in the DJE).
Action recommended
Considering the implementation of this new system, it is essential that the DJE is registered by May 30, 2024, and the internal practices used by companies to monitor judicial lawsuits are revisited, especially considering the possibility of imposing fines and impacts of the non-compliance with deadlines for companies.
