New Federal Decree on the disclose of automotive fuel prices to consumers
In brief
On February 23, 2021, Federal Decree No. 10,634/2021 was published, which regulates the disclosure of automotive fuel prices to consumers.
The Decree establishes obligations that must be observed by the fuel retailers in relation to the content, form and type of information that must be available to consumers regarding the prices, discounts and taxes applicable on the price of automotive fuel.
Main rules
The determinations made by the Federal Decree are based on the consumer’s right to receive correct, clear, precise, ostensible and legible information on automotive fuels prices throughout the national territory.
When the rules become enforceable, fuel retailers will need to inform consumers about fuel prices and promotions in the formats established by the Decree, which include the disclosure of original and promotional prices, amount of discounts – through percentages or actual amounts – in addition to specific information about loyalty apps.
In addition, the retailers must inform the estimated values of taxes on the offered goods and services. This information must be posted on a visible place inside the establishment on a panel, which must also observe specific regulations provided for in the Decree.
The provisions of the Decree will come into effect within 30 (thirty) days from the publication of the regulation.
