ENVIRONMENTAL | RIO DE JANEIRO DEFINES PRIORITY CRITERIA FOR THE DESTINATION OF RECYCLABLE WASTE
Joint Resolution SEAS/INEA No. 29 was published on 5 November 2020 in the Official Gazette of the State of Rio de Janeiro. It defines priority criteria for the destination of recyclable waste to associations and cooperatives of reusable and recyclable materials.
Large solid waste generators shall prioritize collector’s associations and cooperatives formed by low-income people while disposing their recyclable waste. In turn, the associations and cooperatives shall registry with INEA (State Environmental Protection Agency).
The Resolution guarantees to companies that the prioritization will not interfere in the right of alienation of goods. However, the large generators will have to quote at least three associations or cooperatives that are registered to inform the waste’s nature and quantity, the deadline for reply (at least two days) and, when applicable, the minimum price when it comes to public sale or the required price when it comes to the modality of exact price. If the proposal has an exact price and none of the associations or cooperatives respond in a timely manner, the generators will be free to dispose their recyclable waste in the available market.
The associations and cooperatives must manage the waste’s final destination in an environmentally sound manner and must issue the waste manifest according to the applicable legislation.
