ENVIRONMENT | ADMINISTRATIVE DEADLINES RESTORED IN THE BRAZILIAN STATE OF RIO DE JANEIRO
The administrative deadlines regarding compliance with environmental obligations have been restored in the Brazilian State of Rio de Janeiro. The suspension of deadlines started on March 16, 2020 with the publication of State Decree No. 46,970/2020, and lasted until August 11, 2020 with State Decree No. 47,205/2020.
The Industrial Federation of the State of Rio de Janeiro (FIRJAN) issued a Technical Notice on September 25, 2020, to inform and clarify that State Decree No. 47,205/2020 also revokes the previous State Regulation that suspended deadlines for compliance with environmental obligations in the State.
In this sense, the State Environmental Protection Agency (INEA) established a new deadline for the submission of the Packaging Declaratory Act (“ADE”, in Portuguese), which is now due on October 31, 2020. In its turn, the presentation of the Waste Inventory is now due on November 30, 2020.
The ADE is a document that needs to be presented by producers, importers and packers of products commercialized in the State of Rio de Janeiro, as set forth by State Law No. 8,151/2018 and Resolution SEAS No. 13/2019. The document needs to convey figures on the amount of packaging put onto the market, as well as the percentage that has been destined to the recycling industry.
