BPTO ANNOUNCES THAT CO-OWNERSHIP IS AVAILABLE AS OF TODAY
The Brazilian Patent and Trademark Office (BPTO) has published a notice informing that the regime of trademark co-ownership is effective as of September 15, 2020. Thus, it is now allowed to register a trademark in the name of more than one owner through new filings or assignment of existing applications or registrations. The co-ownership, previously formalized through contracts between private parties, will bring more effectiveness to the protection of Industrial Property rights of individuals and businesses in Brazil.
The BPTO also informed that the division of trademark registrations and applications will only be implemented as of July 1, 2021. This mechanism will allow splitting the case when, for instance, the registration of a trademark is not possible in some of the classes of products and services claimed.
